Matapos ang P50-M tax erasure… SALCEDA SA BIR: DUE PROCESS TIYAKING PABOR SA TAXPAYER

Naglabas ng reminder si House Ways and Means Committee Chairman at Albay 2^nd District Rep. Joey Salceda sa Bureau of Internal Revenue (BIR): “Always ensure due process in favor of the taxpayer.”

Ito ang kanyang binigyang-diin matapos magdesisyon ang Court of Tax of Appeals (CTA) na kanselahin ang higit P50 milyon na tax liabilities pabor sa IBM Plaza Condominium Association, Inc. sa Quezon City.

Pinaboran ang naturang condominium matapos mabigo ang BI na magpadala ng notice of informal conference sa taxpayers, na nag-lapse na sa due process.

“Not following due process to the very extreme leads tax cases open to litigation. When tax dues are litigated, we don’t get to collect immediately. The government already loses, even when it wins the case in the end,” ayon kay Salceda.

“So, I strongly remind the officials of the Bureau of Internal Revenue to make sure every process is according to the law, regulations, and standards of due process. Nothing should be left to chance,” dagdag ng Bicolano.

Sinamantala niya ang oportunidad upang i-highlight ang kahalagahan ng “Ease of Paying Taxes Bill,” isang bagay na sinasabi niya na makakapigil sa future violation ng karapatan ng mga taxpayer at due process.

“The measure will make tax procedures simpler, hopefully reducing litigation and disagreements between tax authorities and taxpayers,” paliwanag ni Salceda.

“Ease of Paying Taxes will make taxpayer rights clearer, so BIR doesn’t violate them. A BIR that is a stickler for due process to the last detail is a BIR that is more immune to tax cases. That’s good for everybody, taxpayer and government alike,” saad niya.

Inaasahan niyang didinggin ng Senado ang naturang panukala sa Nobyembre kapag ipagpatuloy nito ang regular na sesyon nito.

Si Salceda ang principal author ng House Bill (HB) 4125 o Ease of Paying Taxes Bill. Inaprubahan na ito sa huli at ikatlong pagbasa ng Kamara noong Setyembre 26, ang final step bago ang transmission nito sa Senado.
