The DOLE will conduct a meeting with labor groups on Tuesday, Oct. 12 regarding the plan to waive, defer and or exempt companies from payment of 13th month pay.
In that meeting, we will maintain that the 13th month pay is moot because it has been accrued and earned by employees since January 1, 2020 up to present. It cannot be waive, forgone, cancelled, deferred or unpaid. Gaya ng taxi meter na naibaba na ang metro na patuloy ang pagpatak.
Besides, there is no reason for micro and small business to defer or be exempted in paying the 13th month to their employees because there is a forthcoming P150 billion economic relief cash assistance through the ARISE program of government in tje Bayanihan 2 budget that would be given directly to small business to help rhem cope with the economic crisis.
Lastly, there is no provision in the Thirtheenth Month Pay Law or PD 861 that allows exemptions or defers payment of.
