Report your company not giving 13th month pay

It is mandatory for all employers and companies to give thirteenth month pay to all its rank-and-file employees on or before December 24.

The law requires principal business owners to give its regular employees 13th month pay equivalent to one month salary.

These includes contractual and end-of-contract five months workers. Manpower agencies and service providers are required by law to also give 13th month pay.

Resigned and even those who worked for less than a year are entitled to 13th month pay.

13th month pay is also different from Christmas bonus. Christmas bonus is cash or kind and voluntary on the part of the employer.

13th month pay must be in cash and can be given in installment.

For companies who are unable to pay employees on December 24, you may report them to Department of Labor and Employment Hotline 1349.

Whwm reporting, be ready with your name, your contact number, your company name, company complete address, telephone numbers, number of employees. Your identity will be kept secret. 

We have to push the DOLE to do its job in implementing the law on 13th month pay.

Ang 13th month law does not have teeth or it does not have penalty to those employers and companies who do not comply with it. Walang ngipin ang batas kung kaya’t walang napaparusahan sa mga hindi sumusunod.
