LACSON: IMPEACHMENT TRIAL MAGKO-CROSS OVER SA 20TH CONGRESS

NANINIWALA si Alyansa Para sa Bagong Pilipinas senatorial candidate Panfilo Lacson na malaki ang tsansa na mag-cross over sa 20^th Congress ang impeachment trial ni Vice President Sara Duterte.

Sa Kapihan sa Manila Bay forum, ipinunto ni Lacson na walang sapat na oras ang 19^th Congress para mag-convene at magsagawa ng trial bago mag-adjournment sine die sa huling linggo ng Hunyo.


Dagdag ni Lacson, magkakaroon ng ibang personalidad ang Senado sa impeachment trial, dahil ang gawain ng mga senator-judges dito ay mas malapit sa huwes at hindi mambabatas.

“My humble opinion being a layman, as an impeachment court, hindi nag-a-act ang Senate as a legislative body. Hindi legislative action ang called kundi ibang constitutional body na yan,” saad ni Lacson.

“Iba ang personality ng Senate, impeachment court ito, hindi magsasagawa ng legislative act kundi mag-tackle ng impeachment trial,” dagdag niya.

Dagdag pa ni Lacson, maaaring ituring ang Senado bilang impeachment court na isang “continuing body,” kahit na may aalis matapos sa 19th Congress at may bagong papasok sa 20th Congress.

Aniya, maraming legal luminaries na ang nagsabi na ang Senado bilang impeachment court ay maaaring ihalintulad sa dibisyon ng Sandiganbayan, Court of Appeals, o kahit ang Korte Suprema.

“Pag may nag-retire na member ang division, hindi hihinto ang kaso… Hindi mahihinto ang kaso at hindi ililipat. Hindi mawawalan ng jurisdiction ang division maski may umalis at may pumalit na justice” aniya. Naniniwala naman si dating Senate President Vicente Sotto III na dapat tinalakay ng Senado ang usaping impeachment sa plenaryo noong Pebrero 5.

Naniniwala siya na ang hakbang na iyon ay magbibigay-daan sa komite sa mga alituntunin na talakayin ang usapin kahit na sa panahon ng session break.

“For us, what they should have done — this is just my opinion — if they received (the Articles of Impeachment), they should have reported it to the plenary, and that it be referred; the impeachment be referred to the committee on rules so that during the break, the committee on rules can act,” saad niya.

“They can talk about it. They can convene a hearing. They can convene a meeting […],” inirekomenda ni Sotto.

“The Senate also always passes a resolution, sometimes every one year, every year, a resolution saying that the committees may continue and may conduct hearings during the break,” suhestiyon pa niya.

“The committee on rules can act on this but I don’t know. It was their decision not to refer it to the plenary,” obserbasyon ng dating Senate president.
