HATOL NG SC: BGC SA TAGUIG

Pumabor ang Korte Suprema sa Taguig City para sa pagmamay-ari ng Fort Bonifacio, na kinabibilangan ng business district na Bonifacio Global City, matapos ang mahigit dalawang dekada ng agawan sa teritoryo sa Makati City.

Ginawa ring permanente ng high court ang writ of preliminary injunction na inisyu noong 1994 ng Regional Trial Court ng Pasig na nagpahinto sa Makati City “from exercising jurisdiction over, making improvements on, or otherwise treating as part of its territory, Parcels 3 and 4, Psu-2031, comprising Fort Bonifacio.”

“Clearly, the greater weight of evidence, consisting in contemporaneous acts by lawful authorities, favors the position of Taguig,” saad sa 53-pahinang desisyon na isinapubliko nitong Miyerkoles.

“Considering the historical evidence adduced, cadastral surveys submitted, and the contemporaneous acts of lawful authorities, we find that Taguig presented evidence that is more convincing and worthier of belief than that proffered by Makati. Consequently, we rule that Taguig has a superior claim to the disputed areas,” saad pa rito.

Nag-ugat ang kaso sa reklamo ng Taguig City na inihain sa RTC ng Pasig noong 1993 laban sa Makati City “sa mga lugar na binubuo ng Enlisted Men’s Barangays (EMBOs) at ang kabuuan ng Fort Andres Bonifacio.”

Noong 2017, pinasiyahan din ng Court of Appeals na ang BGC ay nasa loob ng teritoryo ng Taguig City.
